The traditional criminal laws have proven their shortcomings and ineffectiveness in addressing the phenomenon of violence and criminality in residential neighborhoods, which are increasing day by day.

This prompted the Algerian legislator to put in place a new legal framework under Ordinance 20/03, through whichitaims to keep pace with the developments of this phenomenon? It has adopted a dual strategy that combines the preventive dimension of neighborhood gang crimes based on prevention, sensitization and early detection mechanisms of crime undertaken by all public institutions, administrations and civil society actors.

and the therapeutic or deterrent dimension based mainly on the criminalization of all behaviors and activities related to the neighborhood gang on the one hand, and the imposition of harsh and severe criminal penalties on each contributor to the commission of these crimes.

This is what we will try to detail through this intervention, while saying whether these measures are effective or not

Les lois pénales traditionnelles ont prouvé leur insuffisance et inefficacité face au phénomène de violence et de criminalité dans les quartiers d’habitation ; un phénomène, en dangereuse évolution, qui a inciter le législateur à opter pour un nouveau cadre juridique et institutionnel.

Ainsi, l’adoption de la loi n° 20-03 vise à suivre de près l’évolution du phénomène.

Ce faisant, le législateur opte pour une double stratégie combinant la dimension préventive et dissuasive couplée avec la criminalisation de tous les comportements et activités liées aux gangs sévissant dans les quartiers d’habitation.
