يقال إن حرمة العقد تتحدد باستقلالية الإرادة التعاقدية، لقد أثبت التطبيق الحرفي لهذا المفهوم التقليدي حظر تدخل كل طرف غير تعاقدي في العقد، إيمانا من المتعاقدين أن استقلالية الإرادة كفيلة لوحدها بتحقيق الأمن العقدي، متجاهلين بذلك مقتضيات العدالة العقدية، كما أن العقد مدين للمتعاقدين بالمحافظة على القوة الإلزامية، لكون أن وظيفته الأصلية تتمثل في تجنب احتكاك الطرف القضائي بالعقد، الذي يعتبر طرف ثالث مستقل عنه.
غيرت الرؤية الإصلاحية الجديدة لقانون العقود الفرنسي من هذا المفهوم التقليدي، الذي تربع على عرش النظرية العامة للعقد لسنوات مضت، بعدما كشفت عن وجود ثغرات تعاقدية، طرحت على الساحة القانونية عدة إشكاليات، ترجم البعض منها في معادلة اختلال التوازن العقدي بين المتعاقدين؛ الوضع الذي التفت إليه القضاة باجتهادات منوهة لصناعة تشريعية إصلاحية، داعمة لفكرة منح القاضي مكانة جديدة منهكة بأدوار مستحدثة باعتباره الطرف الضامن لفعالية العقد.
Abstract EN
It is usually affirmed that the sacredness of the contract is determined by the autonomy of the will of the contracting parties, However, the strict application of this traditional concept leads to the prohibition of any non-contractual interference in the contract since it is capable of achieving contractual security even if it violates contractual justice.
Moreover, the contract requires the preservation of its binding force by the parties, given that its original function is to exclude any intervention of the judge.
However, the recent reform of French contract law is innovative in many regards, particularly the disturbance of the contractual balance.
This situation has been brought to the attention of the judge who has actively worked in this field through jurisprudence opening up a reforming legislative breach that aims to confer to the judge a new role in this field as a promoter of the efficiency of the contract.

On affirme souvent que la sacralité du contrat se détermine par l’autonomie de la volonté des contractants, Pourtant, la stricte application de ce concept traditionnel a engendré l'interdiction de toute ingérence non-contractuelle dans le contrat, et ce, partant du fait que la volonté autonome est apte à réaliser la sécurité contractuelle malgré si elle porte atteinte à la justice contractuelle.
D'autant plus que le contrat lui-même exige la préservation de sa force obligatoire de par ses parties, étant donné que la fonction originale de celui-ci est justement d’écarter toute intervention du juge dans le contrat.
Toutefois, la récente réforme du droit français des contrats se veut novatrice, notamment en ce qui concerne la perturbation du l'équilibre contractuel.
Cette situation a incité le juge d'œuvrer par le biais d'une jurisprudence ouvrant ainsi une brèche législative réformatrice qui lui conférer un nouveau rôle en tant que garant de l’efficience du contrat.
