تهدف هذه الدراسة الى توضيح كيفية ضبط المشرع شروط وإجراءات منح الرخصة الإدارية المعمول بها في إطار رقابة دخول القطاعات الخاضعة لإشراف سلطات الضبط المستقلة بهدف حماية البيئة، بالنظر للتهديدات التي تشكلها النشاطات الممارسة فيها في مواجهة هذه الاخيرة.
وكانت نتائج الدراسة كالآتي: أدمج المشرع الجزائري البعد البيئي ضمن شروط واجراءات منح الرخصة، من خلال وجوب انجاز دراسات التقييم البيئي المتمثلة في دراسات التأثير أو موجز التأثير ودراسات الاخطار في القطاعات المتعلقة بالغاز والكهرباء والمناجم التي أحال بشأنها لنفس التنظيم المعمول به على المؤسسات المصنفة، بينما خص قطاع المحروقات بنصوص تنظيمية خاصة سارية المفعول، أما النشاط النووي فلم تصدر النصوص التطبيقية الخاصة به لغاية اليوم.
Abstract EN
This study aims to clarify how the legislator adjusts the conditions and procedures for granting the administrative license in force within the framework of controlling the entry of the sectors subject to regulation in order to protect the environment, given the threats posed by the activities practiced in them.
The results of the study were as follows: The Algerian legislator included, within the conditions and procedures for granting the authorisation, the necessity of completing the environmental assessment studies represented by:, impact studies or impact summary and risk studies in the sectors related to gas, electricity and mines, which he subjected to the same reglementation applicable to designated institutions , while sector Hydrocarbons, as he subjected it to a special reglementation, and the same thing with the nuclear activity that the legislator singled out with special application texts that have not been issued until today

Cette étude vise à clarifier comment le législateur a édicter les conditions et modalités d'octroi de l'autorisation administrative pour contrôler l'entrée dans les secteurs régulés afin de protéger l'environnement , compte tenu des menaces que font peser les activités qui y sont pratiquées face à ce dernier.
Les résultats de l'étude ont été les suivants : le législateur algérien a inclus, dans les conditions et modalités d'octroi de l'autorisation, la nécessité de réaliser les études d'évaluation environnementale représentées par : les études d'impact ou synthèse d'impact et des études de risques dans les secteurs liés au gaz et à l'électricité et aux mines, qu'il a soumis à la même réglementation en vigueur sur les Établissements Classés, alors qu’il a soumis le secteur des hydrocarbures et l'activité nucléaire à une réglementation spéciale, mais les textes d'application spéciaux n'ont pas été publiés jusqu'à ce jour.
