The trade companies can be operated legally in two ways; one of which is an individual and the other is a collective one, according to the type of each company, which known as the legal management.

however, this type of management is not the only one in the management as an exception of the trade companies; it may be managed actually, and the manager can't behave the legal capacity, so the trade company including the joint stock one, may be conducted through one or both methods, where legal management is considered the norm, actual management is the exception, thus required to identify the legal position for both; legal and actual manager, to determine who is responsible for the abuses which may be committed during the management of the trade company generally, and the joint-stock company particularly.
