After that the criminal responsibility of legal persons has been recognized by most comparative criminal legislation, including Algerian legislation, which has followed this recognition within its general and private criminal codes.

jurisprudence and legislation did not assert on what basis this criminal responsibility was adopted on the shoulders of the private legal person, whether it is derived from the criminal will of the latter or it is derived from the will of the legal person, and accordingly this study aims to decipher the ambiguity of the criminal responsibility of the legal person for economic crimes by highlighting the limits in which the economic crime stems from the self-will of the legal person, and the criminal responsibility of the latter borrowed for the act of others, whether the natural person or the other legal person.

among the results reached is the independence of the criminal will of the legal person in economic crime from the will of others, and there is no relationship to borrow the criminal will of others, whether a natural or legal person, when committed in his name and for his account.
