The recognition of real rights on public property comes as an expression of a legislative approach aimed at valuing public property by strengthening the legal status of occupants of public property to encourage them to invest in the field of infrastructure related to projects of public benefit, but without prejudice to the rule of inadmissibility of disposal, which made the task of the Algerian legislator Similar to his French counterpart, it is a difficult task, as it needs to achieve a balance between two contradictory principles, namely the preservation of public property from private ownership while opening it to private exploitation.
