في ظل التطور المشهود في مجال التكنولوجيا شاع تداول مصطلح الفنتك كثيرا في الآونة الأخيرة بعدما أصبحت أغلب دول العالم تستعين بتقنياتها لتقديم خدماتها المالية، إذ لم تعد الوسائل التقليدية وإجراءاتها البيروقراطية والمعقدة تسد حاجات الأفراد المتطورة والمتجددة في ظل هذا التطور الرقمي المشهود، ونتيجة لذلک کان لابد علينا أن نتناول الأسس الثلاث لهذه التقنية لنکون على معرفة تامة بأصولها التاريخي، وكيف کانت في الماضي وكيف هي في الوقت الحالي لنعرف مدى تناغمها مع فلسفة وأیدیولوجیات الدول المختلفة ومع المذاهب الثلاث السائدة (المذهب الاشتراكي والمذهب الاتحادي والمذهب الإسلامي)، وبالتالي البحث عن أساسها القانوني في ظل المنظومة التشريعية في العراق.
Abstract EN
More recently, the term FINTECH has become more common especially with the significant advancement of financial technologies.
Many countries around the world have been using these technologies in providing financial services since traditional financial methods no longer serve customers’ needs in the digital transformation era.
Thus, this paper analyses the three foundations of this technology i.e., how it was in the past and how it has evolved overtime in order understand its compatibility with the philosophy and ideologies of current main financial regimes focusing on the Iraqi legal system.
