It is worthy to mention that countries which have adopted decentralized administration are characterized by the unity of their legal system, and that administrative units are supervised by the Government.

The Constitution of Iraq 2005 has misinterpreted federation and decentralized administration and, at the same time, has not been able to subject provincial councils to the supervision of the Central Government.

It has also failed in organizing the unsystematically provincial law No.

21, 2008 concerning the joint powers between the central Government and the provinces mentioned in the Constitution.

The study has also introduced a number of suggestions as to making some amendments over certain constitutional provisions and legislations which sometimes contradict the Constitution and which often infringe the widely accepted notions of federation and decentralized administration.
