Abstract EN

This research focuses on the exercise of criminal jurisdiction, by internal criminal courts, between the principle of universal jurisdiction and the principle of international jurisdiction in the prosecution of crimes in Jordanian and Iraqi legislation and some comparative laws, between the principle of universal jurisdiction and the principle of International jurisdiction in the prosecution of crimes in the Jordanian and Iraqi legislation and some comparative Arab and Western legislation.

For the purposes of clarifying the confusion signed by some explanations of the law by giving them to two different competencies (comprehensive and global) one, and to reflect the aspects of agreement and differences between them, and prove their difference from each other.

This research found that Article (10/4) of the Jordanian Penal Code, through which the Jordanian legislator wants to address the International jurisdiction, is unable to address this principle, unlike many comparative legislation such as the Iraqi, which suffices only physical presence.
