We discuss in this intervention the penal responsibility of the doctor arising from the error, which is based on three pillars represented in the error, the damage and the causal relationship.

The doctor's error is represented in every breach or negligence on his part in the performance of his profession, or his neglect, or his failure to perform the special obligations imposed on him by the technical assets of these humanitarian profession.

By studying this topic, we reached conclusions, including: The crime on the part of the doctor or his assistants can only be established by proving the existence of a causal relationship between the error committed by them and the harm caused to the victim.

The doctor shall also be punished if, as a result of his fault, he commits wrongful killing and wrongful wounding on the basis of provisions contained in the Penal Code.
