تعد سلطة صاحب العمل في فرض الجزاءات الانضباطية على العامل من السلطات التي أعطاها المشرع لصاحب العمل من أجل حسن سير المشروع وانتظامه.
إلا أن المشرع لم يعط صاحب العمل فرض الجزاءات الانضباطية بصورة مطلقة بل نظمها ووضع لها قيودا يجب على صاحب العمل الالتزام بها من هذه القيود هي القيود الزمنية لفرض الجزاءات الانضباطية إذ يجب على صاحب العمل فرض الجزاءات خلال المدد الزمنية التي حددها المشرع والا عد أي قرار أو تصرف في فرض الجزاءات الانضباطية خارج المدد المحددة ومن ثم يعد هذا قرارا باطلا ولا يرتب أي أثر قانوني.
Abstract EN
The authority of the employer in the imposition of the disciplinary sanctions is the worker from the authorities made by the goodness and regulation of the work and regularity, but the lawmaker did not give the employer had a divorced authority but organized and setting restrictions that the employer must commit to these time limits for the concepts must impose sanctions during the time limit of any decisiooto or act the conduct of interdependence sanctions outside the specified species.
