In our human world, there is a trend that is growing and expanding at all national, regional and international levels alike, to pay attention to the necessity of the individual human being enjoying a basic set of natural and acquired rights and freedoms, as well as providing protection for them through all documents, regardless of their degrees of binding, whether constitutional or unconstitutional, even if this trend is not The product of contemporary human thought, as historians of human rights principles, global, regional and national humanitarian charters and declarations might imagine, as it traces its roots back to ancient Greek philosophy, human civilizations that preceded birth, and heavenly messages, topped by the Islamic message, and the principles brought by the tolerant Sharia to sanctify right, freedom, and equality to honor human beings.

But despite the care and attention at the national, regional and international levels for rights and freedoms, and despite the brilliance of words and the good wording of texts related to human rights and the necessity of preserving them by everyone, we find there is arbitrariness and violation of the rights and freedoms that a person is supposed to enjoy.

Under the contemporary state, a person cannot fulfill his rights by himself.

In the direct way, he cannot, at the same time, refrain from executing the orders of the public authorities on the pretext of their illegality or violation of the laws and regulations.

Therefore, in order to enable him to exercise his rights, the law had to intervene to regulate this issue and grant, according to this regulation, a set of legal means that enable him to obtain his rights in the face of the actions of the public authorities.
