Abstract EN

This study seeks to reveal the failure of the international judiciary in holding the Israel entity and its criminals accountable for committing the crime of genocide in Gaza strip.

despite the issuance of the international court of justice’s decision regarding this crime, it faces obstacles in the implementation process.

with the possibility of filing a lawsuit before the international criminal court for the same crime, Israel will exploit the legal obstacles from the Rome statute to deny responsibility to its citizens.

based on this legal deficiency and this blockage in implementing the decision of the international court of justice, we call for amending the charter of the united nations, especially with regard to the powers of the security council and the veto right, and introducing amendments to the Rome statute to allow the prosecution of international criminals, regardless of their nationality and wherever they are located.
