The study aims to highlight the new constitutional concept of equality of access to functions and positions in the state, as stipulated in article 67 of the 2020 constitutional amendment.

which is a stark prove to the transformation of the traditional constitutional concept of equal access to functions in the state into a new concept.

under this new concept, the constitutional founder excludes functions and positions related to national sovereignty and security from the scope of application of the principle of equality.

as consequence, it makes the new concept of the principle of equality answer and addresses all the questions that were previously raised about this principle.

it is also in line with the laws on public employment in particular and regulations in general.
