Abstract EN

Most of the international charters and conventions sought to establish the principle of gender equality in all matters related to the provisions regulating the marriage contract, including the CEDAW convention of 1979, which obligated the states parties to it to change their internal laws and bring them in line with the convention.

as a result, the Algerian legislator amended the family law, by abolishing guardianship, granting women the right to contract their marriage by themselves, and involving the wife in the field of managing family affairs.

these amendments are considered foreign to the Algerian society, which is loyal to its Islamic values and morals.

on this basis, our research seeks to highlight the manifestations of the impact of CEDAW on family law, especially the provisions of the marriage contract.
