Arabic Abstract

لا شك أن السلطة والمسؤولية يدوران في فلك واحد فإنما وجدت السلطة تحققت المسؤولية، وأن التوازن بينهما أمر غاية في الأهمية ذلك لأن التساوي في الثواب والعقاب هما ما تستقيم بهم الحياة، وأن القاضي هو شخص له ولاية القضاء يحكم بين المتنازعين وفقا لأحكام القانون، وأن وظيفة القاضي هي من أعقد الوظائف لأنها تستلزم وجوب توافر مواصفات معينة، ودقيقة فيمن يتولى هذه الوظيفة بسبب تعلقها في مسالة العدالة وثقل الأمانة في مجال عمل القضاء.

وقد قطعت الدول المتقدمة أشواطا في تطبيق مبدأ التوازن بين السلطات والمسؤولية، لذا تناولت هذه الدراسة المسؤولية التأديبية للقاضي، وذلك من خلال المقارنة بين تأديب القاضي في الأردن والعراق ومصر وقد سعت هذه الدراسة إلى بيان العلاقة بين تأديب القاضي واستقلاله، كون استقلال السلطة القضائية وما يتمتعون به من حصانة لا تعني عدم مساءلتهم ومحاسبتهم عن الخطأ سوء كانت اهمالا أو تقصيرا صدر منهم في إطار وظيفتهم القضائية بل وحتى خارجهم، والتعرف على الناحية القضائية والقانونية لدور السلطة التأديبية من خلال إبراز فكرة المساءلة التأديبية للقاضي في قانون الدول المقارنة وأن القاضي معرض للوقوع في الخطأ وتوجد جهة مختصة لمساءلته، ومن خلال بيان الأحكام القانونية التي تنظم مسؤولية القاضي التأديبية فإن التنظيم القانوني للمسؤولية التأديبية بحاجة إلى تشخيص بعض أوجه القصور التي تعتري النظام التأديبي للقاضي في تشريعات الدول محل الدراسة، فضلا عن وجود تباين في التشريعات المقارنة فيما يتعلق بالجهة المختصة في إحالة القاضي المخالف إلى المجلس التأديبي.

English Abstract

The study aims at elucidating the concept of the disciplinary responsibility agaist a judge who violates rules as well as the party that imposes the appropriate retribution upon the perpetrator.

This concept tackles the idea of punishing a judge in the countries legislations to show the demerits of disciplinary system.

The study postulate solutions.

The researcher has reached a set of recommendations، most notably، the contrast among comparative legislative laws concerning the party that refers the violating judge to a disciplinary board.

In Jordan and Iraq، the public prosecutor performs disciplinary suit with the verdict of the court council.

On the other hand، in Egypt، the minister of justice or the court president، where the violating judge works، refers the judge to disciplinary action.

Studies show that there is a lack in the insurances related to the verdicts of the disciplinary boards in all of Jordan، Iraq and Egypt.

Egyptian Judicial authority allow to appeal some of disciplinary verdicts but it prevents others from delivering the verdicts.

Egyptian laws forbid appealing the disciplinary action issued by the specialized disciplinary board.

Consequently، the disciplinary action of punishing a judge cannot be appealed by another party because such verdicts are final.

As one of the study recommendation، the researcher urges Jordanian legislators to put disciplinary guarantees clearly whether in investigation or in trial.

Disciplinary authority has to commit to these insurances otherwise the verdict is invalid.

Such action will make the judge feel justice of the disciplinary courts.

Jordanian legislators have to organize plaints more clearly so that mandatory plaint are executed before being in courts starting trials، to mention clearly، presidential disciplinary punishments.

It will cancel the date of appeal.
