Abstract EN

The importance of this study is; it deals with an important event on the national and global arenas, which is the great spread of the new Corona virus (Covid-19) pandemic, affecting more than (35) million people around the world, of whom more than a million have died so far.

The spread of this virus has affected the movement of the global economy, and the health and safety of people in various countries, forcing countries to take precautionary measures to confront it, including closing borders, preventing curfews, imposing wearing protective masks, preventing physical closeness in all its forms, sterilizing places, means of transportation, and other emergency measure.

Therefore, the role of the criminal law comes to govern this pandemic and limit its spread, and to act as a deterrent to those who beg themselves to harm others by transmitting this virus Also, this study raises many questions about the criminal liability of the virus carrier, whether it was done intentionally or unintentionally, and the penalties prescribed for that.

This study has adopted the original analytical and comparative approach between the Egyptian Penal Code and the Omani Penal Code, with support for this by jurisprudence and jurisprudence, in order to achieve the desired benefit from the research." The study concluded with several findings and recommendations, the most important of which is directing the legislator's attention to the necessity of the existence of legislative texts related to criminal responsibility for transmitting viruses and the prescribed penalties, especially with regard to the crimes of bodily harm through the transmission of the emerging corona virus, for the reasons we mentioned through the research.
