Arabic Abstract

جاءت هذه الدراسة لبحث المسائل الفقهية التي اختارها الإمام أبو إسحاق المروزي، من خلال كتاب المجموع للنووي، في موضوع الحج والنذور، التي تدل على نظرته الراسخة في المسائل الفقهية، وبعد جمع الاختيارات الفقهية، تمت مقارنتها بأقوال الفقهاء، وتحليل أدلتها، ومناقشتها والترجيح بينها، باستخدام المنهجين الاستقرائي والمقارن.

وبيان مزايا كتاب المجموع للإمام النووي.

وقد قسم الباحث دراسته إلى من مقدمة وتمهيد وفصلين وخاتمة.

وتوصلت الدراسة إلى نتائج عديدة، منها أن أبا إسحاق المروزي، وافق الإمام الشافعي في مذهبه، إلا أنه خالفه في كثير من اختياراته، ومنها بعض المسائل في الحج والنذور التي وقف عليها الباحث في كتاب المجموع، والتي بلغت أربعة عشر مسألة في الحج، وأربع مسائل في النذور.

وانتهت الدراسة بتوجيه وصية للباحثين بجمع مفردات أبي إسحاق، والقواعد الأصولية التي بنى عليها آراءه في اختياراته الفقهية عموما، وجمع الاختيارات التي وافق فيها أبو إسحاق المذاهب الأخرى.

English Abstract

This study was intended to examine the jurisprudential issues chosen by Imam Abu Ishaq al-Marwazi, through Al-Nawawi’s book Al-Majmu’, on the subject of Hajj and vows, which indicate his firm view on jurisprudential issues.

After collecting the jurisprudential choices, they were compared with the sayings of the jurists, their evidence analyzed, discussed and weighed between them.

Using inductive and comparative approaches.

And an explanation of the merits of the book Al-Majmu’ by Imam Al-Nawawi.

The researcher divided his study into an introduction, a preface, two chapters, and a conclusion.

The study reached many results, including that Abu Ishaq Al-Maruzi agreed with Imam Al-Shafi’i in his doctrine, but he disagreed with him in many of his choices, including some issues in Hajj and vows that the researcher examined in the book Al-Majmu’, which amounted to twenty-five issues in Hajj, and four issues.

The study ended with a recommendation to researchers to collect Abu Ishaq’s vocabulary, the fundamentalist rules upon which he based his opinions in his jurisprudential choices in general, and to collect the choices in which Abu Ishaq agreed with other schools of thought.

For the sake of the above, and out of belief in the importance of the jurisprudential issues related to Hajj and vows chosen by Abu Ishaq Al-Maruzi, through Al-Nawawi’s book Al-Majmu’ and to expand the circle of those who know it, and to contribute to shedding light on this topic, this message came, hoping for God’s help and acceptance.
