The nursery is one of the issues that have become ravaged by Iraqi society with the increase in divorce and separation and the consequent financial and personal consequences, and the amendments that took place on the personal status law in the past decades sparked a great controversy, whether in terms of jurisprudence or society between supporters, opponents and etc.

this was accompanied by a statement by the federal supreme court in this regard, which resolved the controversy, so this was a subject for our research, which represents our comment on article 57 of the Iraqi personal status law in order to stand about the extent of its suitability for the principles of Islam and the requirements of the interest of the custody.
