This study discusses the issue of temporary vacancies for the position of the head of state in Palestinian legislation, and it was addressed at the level of constitutional systems, using the analytical approach, in addition to the comparative approach.

the study presented its main problem, which focused around the statement of the extent of the constitutional precaution regarding the legal regulation of cases of temporary vacancy for the position of the head of state in the Palestinian legislation and the comparative legislation under study? this question was answered by dividing the study into one section that includes two requirements, and the researcher reached a set of results and suggested many recommendations.

the most important of these is setting a constitutional framework and drawing up a constitutional technique by proposing legislative texts regulating the process of temporary vacancy for the position of the presidency of the state.
