This study aims to clarify the shortcomings afflicted in the general laws of protecting the consumer through the presentation of the will defects theory, the hidden defects guaranteed theory and the arbitrary conditions theory.

after studying them, it has been shown to us that they are not sufficient to achieve an effective protection for the consumer who became the weakest party in consumption contracts.

therefore, new legal norms must be found to bring back cognitive and legal balance to the parties of the consumer relationship.
