One of the most recognized legal principles is the presumption of innocence, which dictates that the accused be treated as innocent until proven guilty.

due to the importance of this principle, the Algerian legislator has sought to protect it through various legal safeguards, such as the accused's right not to be compelled to provide evidence of their innocence, their right to defense and to present and explain doubt in their favor.

therefore, the presumption of innocence, under these safeguards, acts as a natural immunity against restrictive and arbitrary measures on the freedom of the accused, such as arrest and temporary detention, which are considered violations of this principle that guarantees fair and independent investigation until a final judgment is rendered.
