Arbitration means the desire of the arbitrators not to submit their dispute to the ordinary judiciary in the state, and to establish their own court, chosen by themselves, provided that they determine the subject of the dispute and the law they wish to apply among themselves, as the arbitrator is not a judge whose choice the arbitrators have no say, but rather a judge of a special type chosen by them, directly or indirectly.

the research aims to identify the cases that can lead to the invalidity of this provision in the Saudi arbitration system of 1433, the nature of these provisions derived from the agreement of the arbitrators to authorize the authority to adjudicate the dispute, and to grant the arbitrator the authority to issue a judgment different in nature from the judgments issued by the judiciary.
