Protecting the principle of competition in public procurements requires a number of legal measures which confine the freedom of the contracting service in attributing the public procurements, including the restriction of its freedom in the choice of the contracting partner, through the creation of a commission, playing a fundamental role in the selection of this partner, called the bid opening and evaluation commission.

given the key role played by this commission in the awarding of public contracts, it requires strict regulation, whether in terms of its composition, operation or missions.

therefore, the purpose of this study is to examine the extent to which the principle of competition is observed in the light of the legal regime of this commission, but also to highlight the loopholes and shortcomings of this regime in order to propose solutions deemed useful in this regard.
