The end of any law is linked to the existence of another law that abrogates it.

however, what happened between international criminal law and international humanitarian law is an equation that proves the theory of the power of applying the latter before the judiciary, which has referred humanitarian law to stagnation, especially since international criminal law has turned violations of humanitarian law into war crimes and applied that before the judiciary, which could not be achieved with regard to international humanitarian law, and here the new relationship between the two laws appears in a way that it is not possible to deal with international humanitarian law as it was previously, especially since many of its texts address states and rely on the approach of violation instead of crimes.

the aim of the research is to show the confinement of international humanitarian law before international criminal law and its impact on the development of war crimes, with a logical conclusion, which is the increasing development of criminal law over humanitarian law, especially before international courts.
