Abstract EN

This article concerns the judicial jurisdiction of the administrative contracts.

The importance of this subject shades some light on the distinctive elements of the administrative contract.

It also draws distinction between the administrative contracts and contracts of private law contracts.

Consequently, it clarifies the nomination of the proper court whether it belonges to the ordinary court or administrative court.

In the present study, the nature of the jurisdiction of the administrative court has been discussed thoroughly by finding the general rule confined to a legal part the liquidation of damages rather than power of cancellation.

It also attempts to highlight some exceptions with regard to the power of cancellation.

In the course of discussion, a comparative study has been made between the rules which are implemented in Jordan and those operating in some other states where a double jurisdiction is found in operation.
