تميز هذا العصر بوجود هجرات كثيرة من المسلمين إلى البلاد الغربية، لأسباب عدة، و أصبح وجودهم في تلك البلاد ظاهرا ملموسا، و هم يحاولون الالتزام بأحكام الشريعة الإسلامية في جميع نواحي الحياة، خصوصا فيما يتعلق بالأحوال الشخصية.
و لكن نظرا لعدم وجود ولاية إسلامية تقوم بتطبيق أحكام الشريعة، و تتولى العناية في الأمور التي تحتاج إلى ولاية، فقد اشتدت الحاجة إلى تبيين الحكم الشرعي في أمثال هذه الأمور الحادثة، و كيف يتم العمل فيها، حتى تكون موافقة للشرع، و من هذه الحوادث التي اشتدت إليها الحاجة و كثر السؤال عنها : مسألة تولي المراكز و الجمعيات الإسلامية لعقود تزويج المسلمين عندما يوجد ما يدعو إلى ذلك، و هل يحق لهذه المراكز النيابة عن ولي المرأة إذا كان غائبا أو عاضلا؟.
فقد حرص الباحث على دراسة هذه المسألة و التدقيق فيها على ضوء الأدلة و القواعد الشرعية، و أقوال الفقهاء في اشتراط الولي في عقد الزواج، و حكم عضل الولي، ثم توصل إلى جواز قيام المراكز و الجمعيات الإسلامية بممارسة هذه الولاية.
Abstract EN
This era is distinguished by the migration of large numbers of Muslims to the West for numerous reasons.
Their presence has become very apparent in western society, where many Muslims are seeking to follow Islamic rules in their daily life, especially with regard to family law.
However, because of the absence of Islamic rule and application thereof in the West, Muslims are asking many questions about issues that concern their daily life.
One such issue regards the role of Islamic centers and associations in acting as the guardian or sponsor in marriage, and whether or not such institutes have the right to do so when the woman’s guardian or sponsor is not present or when her guardian would like to prevent her from marrying.
The researcher observes this issue very carefully through discussing the following: 1) whether or not the woman has the right to marry on her own or whether her guardian must oversee the marriage contract on her behalf after seeking her permission; 2) rulings where the guardian prevents the woman from getting married without any legitimate reason and; 3) the role of Islamic centers and associations in acting as sponsors.
The conclusion reached is that it is permissible for Islamic centers to act as sponsors if they follow certain conditions.
