Abstract AR
يتناول البحث موضوع المسؤولية الموضوعية المترتبة على الدولة عن أفعال لا يحضرها القانون الدولي.
حيث أن نظام المسؤولية قد اكتسب أبعاداً جديدة مع التقدم العلمي و التقني.
فقد أصبحت مسؤولية الدولة تترتب لا عن أفعال مخالفة لأحكام القانون فقط لكن حتى عن أفعال غير مخالفة بل مشروعة، و لكتها ترتب أضراراً بالغير.
لقد قسمنا هذه الدراسة الموجزة عن المسؤولية الدولية الموضوعية إلى مبحثين فتناولنا في المبحث الأول تعريف المسؤولية الدولية و تحديد طبيعتها مع بيان تطورها التاريخي و صورها وفق القانون الدولي العام.
ثم ركزنا في المبحث الثاني على المسؤولية الناتجة عن انتهاك أفعال لا يحضرها القانون الدولي، حيث بينا تطور هذه الفكرة تاريخياً مع تحديد مفهومها و مضمونها في القوانين الداخلية و العلاقات الدولية و أخيراً ذكرنا بعض التطبيقات العملية لهذه المسؤولية ضمن أعمال القضاء الدولي.
Abstract EN
This research deals with the "objective international responsibility" of the state that results from for actions un banned by the international law.
It is significant that the law of responsibility has acquired new dimensions through the scientific and technological progress.
The state responsibility has become the consequence of not only actions that are illegal and oppose the rules of the international law, but also of legal actions that may cause damage to others.
This brief study about the state objective responsibility is divided into two parts.
In part one, we have defined the state responsibility and specified its nature.
We have also reviewed its historical development and forms according to the general international law.
In part two, we have concentrated on the responsibility that results from violating actions which are not forbidden by the international law.
We have expounded how this idea developed historically and its meaning in the internal laws and foreign affairs.
Finally, we have referred to some practical applications of this responsibility within the duties of the international judiciary.Key words : Responsibility, International law, Harming Action, Objective Responsibility.
