Arab judiciary perception of mwaali during the Umayyad regime When discussing the existence of the non-Arab groups in the Umayyad period, the researcher has to raise questions related to their situations beside taking into consideration some Orientalists' perspective Such as Van Floten and Wellhausen concerning the relations between the Arab and the non-Arab groups; namely, Al- Mawali living in the Umayyad era.

The main issue of this paper is to refute the accusation of the Umayyad society of mistreating the other non-Arab groups or even looking down on them .

It has, however, tried to correct that misconception regarding the Arabs discrimination in their treatment between the Arabs and the non-Arab groups, Al- Mawali.

When investigating the historical narratives, the paper found out that the Orientalists' vision is very limited in their perspective labeling the Umayyad society as a "purely Arab" State based on narratives registered in both public historical references and Literature resources.
