Abstract EN

The subject of this research has a paramount importance, dealing with the issue that raises legal problems and in particular the principle of personality of the punishment since the law when punishes the person in whose guardianship the minors enters for an criminal act attributed to the minor the law does not punish him for the criminal act of the minor but for the negligence committed by him in his guardianship.

the recent research is assuring the independency of the act of the minor from the negligence in the guardianship committed by the receiver of the minor ; the negligence of the minor receiver in looking after the minors is the main cause that lead to deviation of the minor and the punishment imposed by the criminal law.
