The contractor might face unexpected circumstances that make the execution of the administrative contract very hard, threatening him with major loss, which may lead to preventing the the public utility from offering what the public needs.

These conditions in the legal system are defined as 'The Theory of Fortuity Circumstances".

Therefor econtracting administration must back up and support the contractor by partial compensation according to the Fortuity Circumstances Theory.

This paper aims to show the importance of this theory.

This paper is divided into three parts and Conclusions, as follows: - First Part: The inception of the Fortuity Circumstances Theory and its development.

- Second Part: The legal bases of the Fortuity Circumstance Theory and its implementation conditions.

- Third Part: The legal invistigation of the Fortuity Circumstance Theory.

All through the comparison between different legal systems, which governs and regulates this theory in France, Egypt and Jordan.
