Abstract EN

This research aims to study the rules of international law related to the terrorism and resistance.

The global instability creates a kind of misunderstanding to the legitimacy of national resistance, which is legal according to the principles and doctrines of the UN Charter, such as the right of nations to self-determination, the right to self-defence, and the doctrine of no using of force, and the principle of respecting human rights.

The current research discuss the concept of national resistance, the legal rules of international law dealing with resistance and its reasons, motivations and aims.

The study explains that the patriotic motive is the distinguishable mark which differentiates between terrorism and national resistance activities.

There are many controversial issue discussed in this research such as the jurisprudence of both terrorism and resistance, international responsibility of both states and individuals for terrorist activities and the international cooperation against terrorism.

The research concludes that the ligitimacy of the national resistance relies on several principles and doctrines adopted by the UN s charter, and that the main motives behind the national resistance activates and actions are patriotic aim at attacking the occupation's forces in order to eliminate the situation of occupation.

Moreover, the national resistance and liberation movements are backed with a huge national support, while the terrorist attacks and activities are legally illegitimate.
