هذه المسالة لها أهمية كبرى في وقتنا المعاصر و ذلك لاتساع استخدامات دم الإنسان و تعدد احتياج الإنسان المريض الى هذا الدم و مكوناته و اتساع رقعة العمليات الجراحية.
و قد اتفق الفقهاء على اختلاف مذاهبهم، على نجاسة دم الحيض و وقع الخلاف فيما عدا ذلك بالنسبة لدم الإنسان على قولين : القول الأول : إن الدم الخارج من الإنسان بجميع أنواعه نجس، و هذا مذهب جمهور الفقهاء من الحنفية و المالكية و الشافعية و الحنابلة و ابن حزم، و قد حكى ابن حزم على ذلك في كتابه مراتب الإجماع. القول الثاني : إن الدم الخارج من الإنسان طاهر كله، ما عدا دم الحيض فإنه نجس، و قد نصر هذا القول الإمام الشوكاني، و الشيخ صديق حسن خان، و رجحه العلامة محمد بن ناصر الدين الألباني و قواه الشيخ ابن عثيمين.
بعد عرض الأدلة و مناقشتها و النظر في أقوال من ذهب إلى أن دم الإنسان نجس و كذلك بعد النظر في فعل بعض السلف من صحابة و تابعين و ما ذكره الإمام الشوكاني و ما آل إليه بعض المعاصرين من أن سائر دماء الإنسان طاهرة ما عدا دم الحيض، و لعدم ثبوت حديث صريح صحيح في نجاسة سائر الدماء دون دم الحيض، مال الباحث إلى القول الأخير و هو أن دم الإنسان طاهر ما عدا دم الحيض.
Abstract EN
This research addresses a significant question: Is human blood Najis or Tahir? This question is of great importance in our present-day world due to the widening use of human blood and the multiplicity of human needs.
That is, patients need the blood and its components as a result of the expansion of surgical operations.
There is consensus among scholars of different schools on the Tahara of menstrual blood.
However, they disagree about human blood.
Their disagreement expressed in two saying.
The first sayings argue that blood which comes out from human beings, of all its kinds, is i Najis.
This view refers to the majority of scholars such as Hanafi, Maliki, Shaafi, Hanbali and Ibn Hazm.
This has been expressed in the book “Ranks of Consensus”.
The second opinion says that human blood is Tahir, with an exception to menstrual blood.
This saying is supported by Imam Shawkaani, Sheikh Hassan Khan, and favored by Mohamed Ibn Nasir Al-Din AL-albani and enforced by al-Sheikh ibn Uthaymeen.
After presenting some evidence and discussing the view that human blood is Najis, while the companions of the Prophet, followers, Imam Shawkaani and contemporaries consider human blood as pure, expect for the menstrual blood.
Because of all this and the absence of frank Hadith on the Najasa of all human blood including blood of menstruation, the researcher tends to say that human blood is Tahir, except the blood of menstruation.
