Abstract EN

Thanks to Allah the God of all creatures and prayers and peace on prophet Muhammad Giziya in the Islamic economical system is considered one of the important issues which took great consideration where Muslims put for it special legal codes organize its work and machinery from these legal points that it is not imposed on those who are incapable or those who it is out of their power.

The Religion of Islam did not enforce men to become Muslims, so there must be taxes system that aid the state to perform its duties toward people.

For the scientific purposes we divided the subject into three inquiries where in inquiry one we tackled the definition of giziya in language and as idiom and it legitimate in Holy Koran and Sunna from prophet Muhammad era (peace and prayers be upon him).

And the imposing of Al- Giziya in Islam As for inquiry two we tackled the amount of giziya and those who are committed to pay it, its time, terms and excluding and in inquiry three we tackled the importance of Al- giziya and compare it with kharage and zakat .Al- Giziya was not punishment.

We had reached through our research to a permanent facts, some of which are: - Al- Giziya was considered one of the important incomes for Bait Al- Mal.

- Al- Giziya was not impose on the handicapped - There were special legitimates for Al- Giziya facilitate its application .
