تبحث هذه الدراسة في أصل من الأصول التشريعية التبعية، و هي الاستحسان من حيث المفهوم و الأنواع، و من قال به من علماء الأصول، و تذكر أدلتهم و أدلة المعارضين له، و تذكر الراجح في ذلك مؤيدا بالأدلة من المنقول و المعقول، كما تذكر فوائد الاستحسان و ثماره، و حاجة الاجتهاد و المجتهد لهذا الأصل، و تستعرض تطبيقاته في أحكام المواريث، و التي يستدل من خلالها على أهمية دائرته و اتساعها، و أن معظم علماء الفقه و الأصول قد قالوا به و لو سموه بغير اسمه.
Abstract EN
This study investigates one of the fondimentals elements of Sharia (Islamic law) called discretion legal matters; Its concept and types, and their evidence and those who are against.
The light is also shedded on the preferred opinion with its proofs and evidences.
It also reveals the importance of Istehsan and the need for it all the time, by giving some examples in the subject of inheritance, and indicating the importance of Ijtehad (interpretation judgment), and it's influence on scholars
