Abstract EN

According last Iraqi Nationality Act No.

43-1963, there was no provision concerning judicial jurisdiction in nationality matters so jurisprudence and judicature attitude in Iraq was divided into two sides: one; accept judicial jurisdiction in nationality matters because nationality is special right according legal system and this right must compare with jurisdiction of judicature, Two; refuse judicial jurisdiction in nationality matters because nationality be concerning with sovereignty of state.

This stag was continued till 1975 -date of order of last leading council of revolution in Iraq, paragraph 1 of this order not recognize by judicial jurisdiction in nationality matters.

Preventing courts was continued till applying of new Iraqi Nationality Act No.

26/2006, according article 19 administrative courts only has judicial jurisdiction in nationality matters, article 20 determines supreme court in nationality matters ( supreme federal court).

My project treats in trails all above stages and kinds of cases in nationality matters;administrative order, mere and follower cases.

Finally, conclusion will contain results and suggestions.
