Abstract EN

The concept of this research is about finding a kind of balance between two elemental principles to establish the state of law having the trust of its people .

The two elemental principles are : The reaction of judgment of unconstitutional and the principle of national security , so we divided this research into two researches , pointed the first principle to know the concept of the two principles and the reasons of their applications , at the same time we pointed the second research for the limitation of the method of balance between the two principles firstly, and the applications of countries to this method of balance.

Finally we finished this research with many results and recommendations
