Abstract EN

Travel in the world or tourism is an essential part of human life.

In fact, it is ingrained in human nature.

Man, on the earth planet, has engaged in travels since the dawn of human history.

He has under-taken such travels to seek knowledge and earn livelihood.

In the world today, such travel has developed and assumed a new form.

It is termed tourism.

It is considered a most profitable industry.

In fact, it serves a decisive source of income.

In turn, it provides im-petuous in boosting national economy.

Coupled with tourism, as an industry, are multiple facilities of recreational orientation.

All such developments are on constant rise.

The progressive development of tourism as an industry has given rise to new issues and new problems that need legal explanations.

The present study, on this score, provides illuminating presenta-tion.

The latter reflect twin stances Sharia and modern law.

All in all, the following issues are pinpointed : 1.

The rarity of juristic explanations associated with tourism ; 2.

Strong linkage between tourism and security; 3.

Sharia injunctions on travels for three-fold objectives knowl-edge ; livelihood ; and medical treatment.

4.

Sharia injunctions on the travels of Non-Muslims into Muslim Lands ; and 5.

Combating new crimes associated with travels or tourism within the contexts of both Sharia and modern law.

The present study, in its conclusive section, offers some recom-mendations.

The latter provide insightful views on the broad concept of tourism.

Also, these incorporate some dimensions of Islamic Sharia.
