Abstract EN

The study sheds light on the competence of the Permanent International Criminal Court due to the fact that competence is the legal basis for any legal judiciary system, besides discussing the rules of trial which are the procedures followed by the Court in investigating any legal case.

The claim case is the start point for the Permanent International Criminal Court and without it the Court will be stand still and inactive.

Finally, the study concluded with indicating the obstacles that limit the effectiveness of the Permanent International Criminal Court as its establishing by-law is dominated by the politics of big powers through inserting certain articles that hamper the effectiveness of the Court.

Hence, the researcher has to manifest the pros and cons of such establishing bylaw which is relatively new.
