Arabic Abstract

لقد كان القصد من هذه الدراسة التعريف بالعلامة المفسر ابن عاشور يرحمه الله، و منهجه العلمي و اكتشاف المنظومة المصرية التي بثها في ثنايا تفسيره القيم (التحرير و التنوير) و التي قصد بها فتح آفاق رحبة أمام المفسر و الفقيه و معالجة المستجدات و استشراق المستقبل الأفضل للمسلم المعاصر عبر هذه المنظومة المقصدية في إطار التنظير و التطبيق.

ففي إطار التنظير قرر ابن عاشور يرحمه الله بأن علم أصول الفقه بوصفه الحالي لا يمكن أن يفي بحاجة العصر و الفقيه في تناول النصوص و تكيفها حسب مستجدات الزمان والمكان و تنوع ظروف الإنسان مما حدا به إلى إقرار علم مقاصد الشريعة بدلا عن علم أصول الفقه و هل لهذا العلم (مقاصد الشريعة) منهجا و حدد له ضوابط و اطر له أطرا تمكن المفسر و الفقيه من تحديد المقاصد الشرعية من تحديد المقاصد الشرعية و هي نوعان : معان حقيقية تدرك العقول السليمة ملاءمتها للمصلحة أو منافرتها لها، إدراكا مستقلا عن التوقف على معرفة عادة أو قانون.

- و معان عرقية و هي المجريات التي الفتها العامة و استحسنتها استحسانا عن تجربة.

- و في إطار التطبيق : لا يخفي أن المجالات التطبيقية في تفسير ابن عاشور للقرآن قد حاول فيها تطبيق نظريته المقاصدية في مواضيع متنوعة و مجالات مختلفة في أحكام الأسرة و التصرفات الآلية و العقوبات و القضاء و غير ذلك.

و من خلال هذه الدراسة فقد تناولت في مجال التنظير الاجتماعي مقاصد سياسية النفس، و مقاصد سياسة المال و في المجال المنهجي اخترت مقاصد التدرج القرآني عبر قضايا النسخ في القران، و في مجال العقوبات مقاصد تحريم الربا و مقاصد سياسة النفس، و مقاصد سياسة المال .

و في المجال المنهجي اخترت مقاصد التدرج القاني عبر قضايا النسخ في القرآن، و في مجال العقوبات مقاصد تحريم الربا و مقاصد تحريم الخمر و القصاص.

و مما بعد جديدا في دراسات ابن عاشور إدخال مقاصد التفكير و مجالاته ضمن قضايا الاعتقاد و تقريره أن أعمال الفرد جارية في الصلاح و الفساد حسب تفكيره و يبدو أن ابن عاشور و قد نزع هذا المنزع إثبات أن التفكير و التفكر و التدبر مقصد أساسي من مقاصد الرسالة الخاتمة، و في جانب إصلاح الأعمال البشرية يرى أن معنى الإصلاح في العمل إلا يكون العمل مغضبا إلى مفسدة أو إضاعة مصلحة.

و لقد كانت الصورة المنهجية بشقيها : صفة عموم الرسالة و دوامها وصفة اليسر و الفطرة واضحة المعالم يرى ابن عاشور لذا نلمس في تعامله مثلا مع قضايا أصولية شائكة مثل قضية نسخ القرآن أن ربط النسخ ببحث المقاصد ربطا مباشرا، و ذكر أن المقصد من النسخ هو تعليم المسلمين أصلا من أصول الشرائع.

English Abstract

The application methodology of Quran visions .

Objectives theory of Ibn A'ashoor .

The aim of this study was to introduce the expert and explanatory inb A'ashoor – the nurcy of Allah upon him – and his scientific method and discover of destination system which he published in his valuable explanation of Quran folders named (Eltahjir was Eltanwir) or (liberationand en lightening ) by which he meant to open a large horizon for explanatory and jurist to deal with or (recent) modern issues and looking forward for the best future for Muslims through this destination system in the circumstance of theories and applications or practicing .

In the theoretical field, Ibn A'ashoor decided that the current principles of understanding (Fight) with it's recent status nerver meet the need o this time and justice in dealing with texts, and adapting it according to the period of time, place and different conditions of people, so he acknowledge destination of sharia'a science instead of principles of understanding .

And made for this science (Destination of sharia'a) curriculum and he determine it's controls and set surroundings that enable the explainer (Musfasir) and jusrist (Fagin) to define the destination of sharia'a (Islamic law ) which has two types : 1- Actual meanings which understand with fit brains against it, the understanding must be independent from limitation of acquaintance habit or law.

2- Traditional meanings: it's the progress or ways used to by public and approved it after practice and experience.

• In Application Field: it is clearing the application domain of Ibn Aishoor explanation of Quran; he tried to apply his destination theory in different affair and various field e.g family issue, dealing with money, punishments, judge and soon .

Through this study, I took in consideration in the field of ocial theories, the destination of soul or person policy and destinations of money policy.

In the procedure field I select the destination of Quran progress through the cases of invalidate in quran, and in the fild of punishments the destinations of usura taboo and destination of wine taboo and punishment.

The new thing in Ibn A'ashoor studies, entering of thinking destination and it is scopes with in the belief, and his resolution that the person perform or work can be honest or spoiled according to his her thinking.

It seems that Ibn A'shoor do so, as to give evidence that thinking scrutinize and ponder is amain destination of the final message.

In the side of reform the human being performance.

he see that the meaning of reforming the work, is that the work must not lead to any corruption or losing advantage.

The systematic vision was, with it is two sides, the the feature of the generation of the message and it sontinuty and the feature of easiness and clear seen porture of ibn A'shoor, so difficult matters like the invalidation of Quran when he link the invalidation with the destination in adirection is to teach Muslims one of the main principles of origins of sharias .
