Abstract EN

Constitution provisions are normally formulated by using specific terms.

The meaning of such terms are usually determined by given interpretation in the light of the intention of the legislation.

The Jordanian Constitution of 1952 has adopted the principle of separation of powers, provided that balance is maintained between the Legislative and Executive Authorities.

The parliamentary system in Jordan has been derived from this balance.

The Jordanian Constitution has stipulated the procedures of its interpretation by forming the High Council for Constitution interpretation.

The Council’s tasks have been limited to Ministers trial when they do not perform their tasks properly, and to the interpretation of the constitution's provisions .

Taking into consideration the importance of the role of the said High Council , this paper attempts to study some decisions made by the Council for the purpose of explaining the constitution provisions regarding the general principles of the parliamentary system in Jordan.

The contribution of the High council decisions has been humble in the academic aspect.

Its role has beem limited to show how these provisions have been implemented.

Therefore , it is important to replace the political Jurisdiction by forming a constitutional court instead of the High council as it is adopted in the developed countries.
