Abstract EN

This research studies the possibility of depending upon jurisprudence principles to reveal judgement upon matters and affairs that no special texts decreed for them.

The study aims at showing that the use of the jurisprudence principle and its application in the status of indication stands upon two cases: first: The right meaning , powerful content, and ascendancy of judgement which is expressed through the jurisprudence principle needed to be applied.

This happens through its proof which approves the ascendancy of deducing from it and from the convincement of the scholars with it.
