Abstract EN

According to the early muslim scholars, and some contemporary researchers belligerence forms the basis of relation between the Islamic State and the non-muslim communities which do not bear allegiance to the Islamic State.

They interpret the concept of Jihad or the fighting in the way of God to be demanded by Muslims to others to fight unless they convert to Islam or submit to the authority of the Islamic State by contract of Ohemmah.

And it makes no difference whether the non-muslims are belligerent or otherwise.

On the other hand, many contemporary researchers believe that the basis of the Islamic State relation with non-muslims is peace.

War against non-rnuslims as they see it, was legitimized for the necessity of selfdefense only.

Therefore, this article examines these opposing views, their arguments, proofs, and, at the end, the writer will express his own conclusion.
