The research aimed to define victimology as anew notion in penal sciences, it was clear from this definition the importance of the role of the victim in the prevailing of the criminal behavior on one side.

On the other side the prevention of the crime.

This notion is new in terms of the addition of the principle of the victim to the other principles of the crime.

After a long time the penal legislation give a great importance to the criminal, the crime and the penal policy.

As an example, The Algerian legislator has neglected the principle of the victim and his role in the penal legitimacy, it is clear from showing some theoretical types that victimology and its relation with the criminal behavior plays a great role in the prevention of the crime.
