جاء قانون الإجراءات المدنية و الإدارية بقواعد و أحكام جديدة تمس صلاحيات محافظ الدولة، أحد أهم هياكل مجلس الدولة و المحاكم الإدارية، إلا أن هذه الصلاحيات لم تعزز دور هذا المحافظ إلا بنسبة ضئيلة جدا و لم تمنحه الوسائل القانونية التي تمكنه من أداء دوره على أكمل وجه، و السبب في ذلك يعود إلى أن المشرع الجزائري لم يفهم دوره الحقيقي لحد الآن و المتمثل في عرض رأيه القانوني من حيث القانون و الواقع حول الإشكالات الممثلة في موضوع النزاع و حلولها القانونية في جلسة علنية و بكل استقلالية و حياد تام.
Abstract EN
The Algerian legislation enacted, through the code of civil and administrative procedure, new rules that govern the competence of the Commissioner of State, considered as one of the pillars of the Algerian State Council and of administrative courts.
However these new rules do not give the State Commissioner the place he deserves, for the legislator could not conceive the real role of the commissioner, whose mission is to present, in a strictly neutral manner his opinion on businesses, queries and to suggest solutions.
Consequently, the Commissioner of State must propose a solution to the judge, who must take into consideration the facts and law.

Le législateur algérien a édicté à travers le code de procédure civile et administrative, des nouvelles règles, qui régissent les compétences de commissaire d’Etat, considéré comme l’un des piliers du conseil d’Etat algérien et des tribunaux administratifs.
En revanche ces nouvelles règles n’ont pas donné au commissaire d’Etat la place qu’il mérite, par ce que le législateur n’a pas pu concevoir le réel rôle du commissaire, qui a pour mission d’exposer, en toute neutralité, son avis sur les affaires, les requêtes et sur les solutions proposées.
En conséquence, le commissaire d’Etat doit proposer une solution au juge, qui doit prendre en considération les faits et le droit.
