Abstract EN

This study highlights the importance of International Humanitarian Law to the Palestinian cause, as the legal framework that governs relations between the occupying power and the people under occupation.

It analyzes the various Palestinian positions on the applicability of International Humanitarian Law in the Occupied Palestinian Territories, and indicates its importance in the Palestinian political discourse.

It also analyze the different Israeli positions on the applicability of that law in the Occupied Palestinian Territories, especially in light of changes that took place on the ground after the Oslo Agreement in 1993, and the Israeli withdrawal from the Gaza Strip in 2005.

The study also tackles the legal status of the Occupied Territories in the aftermath of the acceptance of Palestine as a non-member state at United Nations, and how the Palestinians can take advantage of international humanitarian law for the benefit of the Palestinian cause.
