ابن حبيب المالكي و آراؤه الفقهية في كتاب النكاح

Abstract EN

After studying his life and his knowledge Ibn Habeeb was not only extraordinary in Doctrine, but also he was great in poetry and Hadeeth.

But late in his life some defects were taken upon him, such as poor memorizing, which I out balanced and that due to the fact that his opponents were filled with envy, because of his fine political and scientific stature.

Through all of the above I can score the following remarks : A-His life : 1.

The historians differed about his date of birth, so I suggested it was in the one hundred and seventies.

My goal was to gather all the narrations that happened in during his birth.

His death was in two hundred thirty nine H, yet some dissimilarities were found.

His fame was beyond Andalusia to reach out the whole of the Islamic world, which meant that he had students who were not of less cleverness than their master, whom took the knowledge and spread it around the globe.

B-His jurisprudential views : To the followers of Ibn Habeeb jurisprudential views find a jurisprudential voice and had a fine position among the scholars and that would not had been unless he had clear mind, pierce vision and an extremely brilliant memory.

Finally I recommend that Ibn Habeeb should take a supreme place in the study and show his high jurisprudential views which cannot be ignored, done without or forgotten, because of what they have of clear significance in the flow of ideas that could not become from nothing, but were the results of the knowledge that he was brilliant in and he was affected by the habitat he was living in.
