Through our research, we noticed that the Kuwaiti constitutional legislator has not singled out a provision about the publication of newspapers, but addressed it within the freedom of the press in general, and freedom of opinion and expression in the text "freedom of the press, printing and publishing is guaranteed according to the terms and conditions prescribed by the law", and "freedom of opinion and scientific research ; everyone has the right to express and propagate his opinion-orally, in writing or otherwise".

The phrase "according to terms and conditions prescribed by the law" stating that the constitutional legislator makes the organizing of publication newspapers for the regular legislator "parliament" not the executive authority.

we concluded from this research that the Kuwaiti regular legislator has failed to regulate the freedom of publishing newspapers-basis of our research-as he did not achieve the required balance between practicing freedom as one of the basic traditional freedoms for individuals and the independence of newspapers, and security and public system, due to the reasons stated in this research.
