لقد أصبح مبدأ التناسب من المبادئ القانونية الشهيرة في القضاء الإداري، إذ استطاع أن يؤسس لرقابة موسعة في إطار مبدأ المشروعية.
فهو قيد اجتهادي على السلطة التقديرية لإدارة للحد من غلوها و ضبطها ضمن حدود المعقول.
إن هذه الرقابة لا تطال إلا أحد مظاهر ممارسة السلطة التقديرية المتعلقة بمدى توافق أثر القرار مع وقائعه، غير أنها خلقت خالفا فقهيا حادا حول مدى تطور قضاء الالغاء إلى اعتماد أوجه جديدة لإلغاء ؟ أم أنها مجرد تطور في الأوجه التقليدية المستقرة ؟ و أمام حداثة هذه الرقابة يبقى للقاضي الإداري الذي أوجدها سلطة الفصل فيها مستقبلا.
Abstract EN
The principle of proportionality has become one of the important mechanisms of the control of legality; it allows the administrative judge to oversee the discretion of the administration assigning broad control over the balance between the facts and the decision.

This development feeds a serious doctrinal debate on the extent of the control carried out by the judge; particularly between the current view of the principle of proportionality as a new means of cancellation, and the other that considers that a recent version of the classical means.

Le principe de proportionnalité est devenu l’un des mécanismes importants du contrôle de la légalité.
Il permet au juge administratif d’encadrer le pouvoir discrétionnaire de l’administration, en affectant un contrôle large sur l’adéquation entre les faits et la décision prise.
Cette évolution a nourri un sérieux débat doctrinal sur l’étendue du contrôle à effectuer par le juge ; notamment entre le courant qui considère le principe de proportionnalité comme un nouveau moyen d’annulation, et le courant qui ne le considère que comme une version récente des moyens classiques.
