This paper deals with spoils and booties (Fayy and Saffiy) between theory and practice in early Islam, according to what is stated in the primary sources.
These were the main sources of the Muslim treasury, and were the funds taken from the non-muslims during wars or after war as Ghanimah by muslims, whether they were movable or fixed, such as land.
The paper will also explain the concept of booty (Fayy) from the linguistic point of view as well as from the Jurisdictional one (Sharia h), and will cite examples of the practical application of the aspects of spending that wealth.
The spoils (Saffiy) is also property acquired by muslims from non-muslims in the course of military confrontations, and they constitute the best spoils of war and are chosen for the Messenger of Allah, and his successors, in recognition of their status.
The cited comparison between the booty (Fayy) and the spoils (Saffiy) in terms of their sources and where they were spent as well as their resemblances and differences, are discussed in the course of this paper as well as the most important findings of the research.
